I removed the error by patching if_re.c with a patch like :- http://www.freebsd.org/cgi/cvsweb.cgi/src/sys/pci/if_dc.c.diff?r1=1.9.2.53&r2=1.9.2.54 (basically pass the mbuf to XX_encap instead of a pointer to it) which was the reason for the INVARIANT in the 1st place.
