Well I'm certain I see the bug now but I believe that path can only be 
triggered by kse.  Perhaps you have some compat based code that is using 
an old library?  Or maybe there is some other place in the kernel that 
uses this feature.  In any event, the scheduler file I posted should fix 
this.
