Its responsibility is to hold the rights to the intellectual property and to do any legal work necessary. The codebase is technically the responsibility of the committers. There is a 'core team', elected by the committers, but its responsibility is more oriented towards mediating inter-committer problems and other related matters. So there is no single 'group' that could establish a rule like this. The way to get something like this instituted is to convince the bulk of the committers that it is a good idea.
