An empty file doesn't generate the error ..

imb_at_vm01:/home/imb> touch xx
imb_at_vm01:/home/imb> cp xx yy
imb_at_vm01:/home/imb>
imb_at_vm01:/home/imb> cp /dev/null yy
cp: /dev/null: Invalid argument
